This week we’re following the latest on the home care regulation, plus a new proposal to align the Affordable Care Act’s wellness provisions with the Americans with Disabilities Act (ADA), Genetic Information Nondiscrimination Act (GINA) of 2008; more on the Medicare Sustainable Growth Rate (SGR) fix and empowering workers with disabilities.

  • The Obama administration is encouraging states to be ready to provider minimum wage and overtime pay to in-home care workers assisting people with disabilities even though a federal judge put a stop to the October 2013 regulation requiring the change earlier this year, reports POLITICO’s Morning Shift and Disability Scoop.
  • A proposed rule addressing the interaction between the ADA, GINA and financial incentives in corporate wellness programs is at the White House Office of Management and Budget, which marks the start of the regulatory process and the stage just prior to public review. The U.S. Equal Employment Opportunity Commission sent the NPRM March 20, per Law360. More on the underlying EEOC v. Honeywell litigation from The National Law Review.
  • Disability Scoop spotlights Best Buddies and related partnerships’ efforts to empower workers with disabilities, specifically tackling the disproportionality high unemployment rate among those with intellectual disabilities.
  • A real fix to the annual SGR patch? The Fiscal Times comments on the likelihood Congress will build on last Thursday’s House vote to ensure Medicare doctors continue to be paid at current rates. Summary of the Bill
